aiding the selection and purchasing of products contained in the on-line catalogue appearing
on this website ("the Products") directly from the member wholesaler.

AIEW and its members reserves the right to refuse to accept orders from and/or supply
Products to any individual or company for any reason whatsoever.

1 Exclusions/Limitations of Liability
1.1 Whilst AIEW its members and suppliers have taken every reasonable precaution in
compiling this website, this website is provided on an "as is" basis. Neither AIEW nor
its members, nor any contributors to the website makes any representations or
warranties of any kind (express or implied) with respect to the contents or operation of
this website (including, but not limited to all documents and graphics posted on this
website) and any such representations and warranties are hereby disclaimed.

1.2 All warranties, conditions and terms of any kind, whether implied by statute or
common law, including without limitation any warranty as to correspondence with
description, satisfactory quality or fitness for purpose, are excluded to the fullest
extent permitted by law.

1.3 Except in respect of death or personal injury caused by AIEW and its members's
negligence, AIEW and its members shall not be liable to you by reason of any
representation (unless fraudulent), or any implied warranty, condition or other term, or
any duty at common law or under any express terms of this agreement, for any
indirect, special or consequential loss or damage (whether for loss of profit or
otherwise), costs, expenses or other claims for compensation whatsoever (whether
caused by the negligence of AIEW and its members, its employees or agents or
otherwise) which arise out of or in connection with the supply of the Products or their
use or resale by you.

1.4 AIEW and its members's aggregate liability under or arising in connection with this
agreement, whether in tort (including negligence) or for breach of contract or
otherwise howsoever arising shall in no event exceed the price of the Products
supplied under this agreement.

1.5 AIEW and its members will not be liable for any damages or losses, whether direct or
indirect, that you may suffer as a result of computer service or systems failure,
including but not limited to server failure, access delays or interruptions, data
non-delivery or mis-delivery, domain name system failure, delays in provision of the
Products, breaches of security or unauthorised use of the system arising from
"hacking" or otherwise, even if AIEW and its members has been advised of the
potential for such damages and even if AIEW and its members may reasonably
foresee the potential for such damages.

1.6 You and AIEW and its members hereby expressly exclude any rights of third parties
who may otherwise be entitled to enforce the terms of this agreement as if they were a
party to it or otherwise able to rely on the provisions of the Contracts (Rights of Third
Parties) Act 1999, as enacted or modified.

2 Price/Availability of the Products

2.1 Prices where quoted are Trade Prices, you should contact your AIEW member for a quotation with latest price and delivery information. The price payable for the Products that you order are as agreed with the member wholesaler. You are referred to the member wholesaler for payment and delivery terms.

2.2 AIEW and its members reserves the right at any time, prior to AIEW and its
members's supply of your order, to revise its prices without notice.

2.3 All orders for Products are subject to availability. AIEW and its members's acceptance
of your Order does not signify availability of the Products. You will be advised of any
delay in delivery of the Products relating to availability.

3 Correction of Errors

3.1 Any typographical, clerical or other error or omission in any document posted on this
website, including, but not limited to any catalogue or Product information, price list,
quotation, invoice, acceptance of offer or other documentation or information shall be
subject to correction without any liability on the part of AIEW and its members.

4 Data Protection

4.1 Any personal data provided by you to AIEW or its members will be used for the
purposes of processing your order. Such personal data will form part of your customer
records and AIEW or its members will be entitled to use it for all purposes connected
with the provision of the Products and any related services. AIEW or its members
may also use your personal data for purposes where it is required or permitted by law.

4.2 AIEW or its members may wish to use the personal data to send you information
about its products and/or services. If you do not wish to receive any such information,
you may send an email to AIEW or the relevant A.I.E.W. member indicating you do
not wish to receive such information.

5 Copyright and Trademarks

5.1 All rights in copyright and trademarks (whether registered or not) and all other
intellectual property rights appearing in this website are owned by or licensed to
AIEW or its members unless otherwise stated.. A.I.E.W. recognise all supplier
copyright & trade marks. You are permitted to retrieve and display pages from this
website on a computer screen and may print individual pages and store pages in
electronic form for information purposes only. You may not copy (otherwise than as
permitted by this clause), reproduce, modify, distribute, republish, display, post or
transmit any part of this website without A.I.E.W.’s prior written consent.

6 Law / Jurisdiction

6.1 These terms and conditions shall be governed by and construed in accordance with
English law and shall be subject to the non-exclusive jurisdiction of the English
Courts.
